Silver is the trading name of Silver DCC Limited and all rights are reserved.

Silver provide access to and the use of this website subject to the following Terms and Conditions. We at Silver Development and Construction Group Limited have implemented this privacy notice to inform you of the types of data we process about you and/or your business. We also include within this notice the reasons for processing your data, the lawful basis that permits us to process it, how long we keep your data for and your rights regarding your data.

This notice applies to our clients, customers and the general public who we are, or have been, engaged with. A separate privacy notice is available on request for;

  • workers and interns/apprentices
  • job applicants
  • sub-consultants

1. Data protection principles

Under the General Data Protection Regulations (GDPR), all personal data obtained and held by us must be processed according to a set of core principles. In accordance with these principles, we will ensure that:

  1. processing is fair, lawful and transparent
  2. Data is collected for specific, explicit, and legitimate purposes
  3. Data collected is adequate, relevant and limited to what is necessary for the purposes of processing
  4. Data is kept accurate and up to date.
  5. Data which is found to be inaccurate will be rectified or erased without delay
  6. Data is not kept for longer than is necessary for its given purpose
  7. Data is processed in a manner that ensures appropriate security of personal data including protection against unauthorised or unlawful processing, accidental loss, destruction or damage by using appropriate technical or organisation measures
  8. We comply with the relevant GDPR procedures for international transferring of personal data

2. Types of data held

We keep several categories of personal data in order to discharge our duties and ensure we carry out effective and efficient business management, administration and processes generally.

Specifically, we may hold the following types of data about you:

  1. personal details such as name, address, phone numbers and email addresses
  2. gender identifiers (e.g Mr, Mrs, Ms)
  3. bank account details
  4. copies of any proof of identity provided to us by you
  5. business cards
  6. letters of appointment and/or contracts exchanged between us
  7. general correspondence exchanged between us, such as letters, emails or voice messages
  8. documentation relating to the work we have or may do for you, for example, details of your property/asset, land registry documents, drawings, photographs and/or reports relating to your property/asset
  9. proposal documents, such as quotations and fee proposals
  10. invoices

Depending on our relationship with you, we may acquire data (on the strictest of need to know bases) relating to;

  1. criminal records
  2. disability and health information
  3. whether you are classified as a vulnerable person

We may acquire additional information from you in relation to events we are hosting, such as dietary requirements/preferences or leisure or hobbies preferences, such as particular events you enjoy or teams you support.

3. Collecting your data

Data may be collected by us from you via;

  • Telephone calls
  • Voice messages
  • Letters
  • Emails and facsimile
  • Our website
  • Feedback surveys
  • Public sources, such as the internet

In some cases, we will collect data about you from third parties, such as government bodies (e.g local authority) or parties connected to a project or case we are involved with; for example, our client (where that’s not you), a design consultant or a specialist contractor.

We keep this data in secure projects files and we also hold the data within our computer systems, for example, our secure cloud server storage facilities.

4. Lawful basis for processing

The law on data protection allows us to process your data for certain reasons only. In the main, we process your data in order to comply with a legal requirement or in order for us to effectively discharge our duties to you.

The information below categorises the types of data processing we undertake and the lawful basis we rely on.

5. Special categories of data

Special categories of data are data relating to your:

  1. health
  2. sex life
  3. sexual orientation
  4. race
  5. ethnic origin
  6. political opinion
  7. religion
  8. trade union membership
  9. genetic and biometric data.

We carry out processing activities using special category data:

  1. for the purposes of equal opportunities monitoring
  2. in our sickness absence management procedures
  3. to determine reasonable adjustments

Most commonly, we will process special categories of data when the following applies:

  1. you have given explicit consent to the processing
  2. we must process the data in order to carry out our legal obligations
  3. we must process data for reasons of substantial public interest
  4. you have already made the data public.

We do not need your consent if we use special categories of personal data in order to carry out our legal obligations. However, we may ask for your consent to allow us to process certain particularly sensitive data. If this occurs, you will be made fully aware of the reasons for the processing. As with all cases of seeking consent from you, you will have full control over your decision to give or withhold consent and there will be no consequences where consent is withheld. Consent, once given, may be withdrawn at any time. There will be no consequences where consent is withdrawn.

6. Failure to provide data

Your failure to provide us with data may mean that we are unable to fulfil our statutory or contractual duties to you. This could include us being unable to enter into contract with you or us being unable to perform our contractual or statutory duties to the fullest extent.

7. Criminal conviction data

We will only collect criminal conviction data where it is appropriate given the nature of our role and where the law permits us. This data will usually be collected from third parties (such as our instructing client where you are a residential occupier/tenant), however, may also be collected from publically available sources. We will only use criminal data acquired for the protection of our workforce or other individuals who we owe a duty of care to. We rely on the lawful basis of our legitimate interests to process this data.

8. Who we share your data with

  • Firms associated with Silver
  • Third party consultants and suppliers working on our behalf
  • Third parties connected to a project or case we are involved with
  • Government bodies and institutions, such as a local authority, HMRC or the Health and Safety Executive (HSE).
  • Companies we recommend or introduce you to (where you have indicated you would like us to).

Data is shared with third parties on a need to know basis unless required by law, for the following reasons:

  • Providing details such as your name and contact details to relevant parties in order for us to discharge our duties;
  • Obtaining confidential professional advice, e.g in respect of legal, accounting and health and safety matters;
  • To procure and administer company insurances, for example Professional Indemnity, Employer’s Liability and Motor/Fleet Insurance;
  • Management and statutory accounting purposes;
  • Provision, maintenance and administration of management and security systems, e.g IT and telecommunications services;
  • We have a legal obligation to disclose such information, e.g disclosure in respect of court proceedings, Office for National Statistics returns or HMRC reporting;
  • To respond to complaints and resolve them
  • To exercise our rights, such as our statutory or contractual rights
  • To arrange and deliver networking events you are attending
  • To arrange and deliver externally run training or ‘CPD’ events you are attending
  • Business marketing and/or advertising initiatives

We may also share your data with third parties as part of a Company sale or restructure, or for other reasons to comply with a legal obligation upon us. We have a data processing agreement in place with such third parties to ensure data is not compromised. Third parties must implement appropriate technical and organisational measures to ensure the security of your data.

We share your data with bodies outside of the European Economic Area. The countries are the USA and Australia and the reason is primarily related to the location of cloud data storage facilities used by third parties engaged by Silver. We have put the following measures in place to ensure that your data is transferred securely and that the bodies who receive the data that we have transferred process it in a way required by EU and UK data protection laws:

9. Protecting your data

We are aware of the requirement to ensure your data is protected against accidental loss or disclosure, destruction and abuse. We have implemented processes to guard against such.

10. Retention periods

We only keep your data for as long as we need it for.

For our clients, we may keep data for up to 12 years after completing the delivery of our services in order to fulfil our contractual obligations, respond to any queries or complaints, undertake any necessary follow up work which may be required and manage any potential conflicts of interest which may arise now or in the future.

Some data retention periods are set by the law. Retention periods can vary depending on why we need your data, as set out below:

11. Automated decision making

Automated decision making means making decision about you using no human involvement e.g. using computerised filtering equipment. No decision will be made by us about you solely on the basis of automated decision making (where a decision is taken about you using an electronic system without human involvement) which has a significant impact on you.

12. Your rights

You have the following rights in relation to the personal data we hold on you:

  • the right to be informed about the data we hold on you and what we do with it;
  • the right of access to the data we hold on you. More information on this can be found in our separate policy on Subject Access Requests;
  • the right for any inaccuracies in the data we hold on you, however they come to light, to be corrected. This is also known as ‘rectification’;
  • the right to have data deleted in certain circumstances. This is also known as ‘erasure’;
  • the right to restrict the processing of the data;
  • the right to transfer the data we hold on you to another party. This is also known as ‘portability’;
  • the right to object to the inclusion of any information;
  • the right to regulate any automated decision-making and profiling of personal data.

13. Consent

Where you have provided consent to our use of your data, you also have the right to withdraw that consent at any time. This means that we will stop processing your data.

14. Making a complaint

If you think your data rights have been breached, you are able to raise a complaint with the Information Commissioner (ICO).
